The Senate has overturned the Abbott Government's Family Court fee increases, voting in favour of a disallowance motion by Australian Greens spokesperson for legal affairs Senator Penny Wright.

The increased fees, which would have particularly affected family violence victims, is the first of the Abbott Government's 2015 Budget measures to be knocked back by the Senate.

Senator Wright said the fee hikes, such as a $350 increase to the cost of a divorce application, were unjustified.

The Australian Greens will move to strike down the Abbott Government's court fee increases, which legal centres have said will delay victims of domestic violence from seeking a divorce.

Australian Greens spokesperson for Legal Affairs Senator Penny Wright, who will introduce the disallowance motion next week, said increasing the cost of divorce applications from $845 to $1195 was excessive.

"It is completely inappropriate to use family breakdown as a cash cow for the government," Senator Wright said.

Federal cuts to legal assistance funding will undermine efforts to tackle domestic violence, say the Australian Greens.

Legal assistance and domestic violence are two separate agenda items for tomorrow's Law, Crime and Community Safety Council Meeting, but the Australian Greens spokesperson for legal affairs Senator Penny Wright says they should be addressed together.

"If the Government is really genuine about addressing domestic violence, they need to fund the services out there helping people to understand their legal options and act on them," Senator Wright said.

The Abbott Government's cruel hike to Family Court fees could delay victims of domestic violence from seeking a divorce, Australian Greens legal affairs spokesperson Senator Penny Wright says.

"When the previous government raised court fees, Attorney General George Brandis called it 'a disguised Labor tax'," Senator Wright said.

"Now he's copying their tricks and using families going through tough times as a way to raise revenue for the Abbott Government."

The Australian Greens have condemned the funding cuts to indigenous legal aid services, which will see the peak body NATSILS close its doors in June.

Spokesperson for legal affairs Senator Penny Wright said the National Aboriginal and Torres Strait Islander Legal Service advocacy was crucial to addressing shocking levels of indigenous incarceration.

"More than one in four prisoners are Aboriginal, despite making up only a fraction of our population. Too many are in jail because of inadequate legal understanding and representation," Senator Wright said.
